The Facts Behind Common Law Marriage

By: Ferdinand Emy

In some countries, such as Canada, common law marriage also applies to those of the same gender. This provides for households to enjoy tax credits for those who do live together but do not want to commit to marriage or religious reasons or personal gain. This is due to the fact that those who have entered into a common law marriage are treated just like a true married couple. Like in many other areas around the world, the only way to get out of one of these marriages is through legal proceedings in court. The amount of time is set on a state or provincial level, which further adds to the confusion. Common law marriage is one of the most confusing types of partnerships that many people find themselves not knowing a part of.

Some provinces have stringent requirements, such as Nova Scotia, British Columbia, Quebec and New Brunswick. Common law marriage is a form of union that takes effect after a couple has lived together for a certain period of time. Common law marriage was abolished in this region of the world in 1753. Legally, it’s counted as a marriage, even though there has been no legal marriage ceremony performed or acquisition of a marriage license. The usual time frame for common law marriage to take effect is 6 months.

This implies that the pair must show to the world that they are like husband and wife although they have not had any legal ceremonies. This means that you must file for a divorce like a true married couple. The primary two that most people have to worry about are the criteria that must be met in addition to the length of time that the couple has lived together. While the country or region that you live in directly affects common law marriage, most areas have one thing in common.

Notwithstanding, once a common law marriage is determined as established, you have the access to many of the same gains of those who are fully married. There are some rules that surround common law marriage. In addition to this, the couple in question must both be of legal age of marriage in the district that they live in. Once you have established that the relationship exists and make use of its benefits, the government sees little to no difference in the couplings, and requires court actions to dissolve such a relationship. This can cause a great deal of confusion for those who find themselves a part of this law.

If you are in this region, it is considered wise to visit a lawyer to determine if you are applicable for common law marriage In the United States, only eleven states and the District of Columbia permit common law marriage. Australia and its surrounding regions have different common law marriage rules depending on where in the area you are at. Canada has some tighter requires for common law marriage, such as having a child or having lived together for at least a period of one year or more. Some of the laws pertaining to this area do not allow common law marriage, while others do. England and Wales do not have any common law marriages, nor any rights to those who are in such a union.

Once you have entered a common law marriage, the only way to dissolve it is through court. The first of these is that the couple must behave as though they are married.

Getting Your Divorce Records

If you are one of those smart individuals that feel it is better to have a copy of your divorce record and not need it than to need it and not have it… This article is for you! I will explain to you how to get a copy of your divorce record as well as what you will need in order to get it.

Your states “Vital Records” office will do a search and tell you when the actual divorce occurred, but will not issue a divorce record. Certified copies of your divorce record or decree are only available from the Clerk of the Superior Court in the county where the divorce was granted. That little fact is worth the time you are investing into reading this article alone.

Information Required When Requesting Your Divorce Records
The person requesting a search for confirmation of a divorce must provide the following information – a signed request and the appropriate fee (see below):

1.    Groom’s full legal name.
2.    Bride’s full legal name.
3.    Date of divorce (month, day, year),
4.    Place of divorce (city, county),
5.    The number of copies requested

Fees
Most states require that payment be received before a record or a service can be provided. Prepayment of the fee is usually due at the time the service is requested and fees are not refundable. You know that the state has to make their money. So make sure that you have all of your information accurate before turning it in.

The fees normally include the search & confirmation of divorce events. In most cases this fee is around $10.00 USD. Multi-year searches or every three years or portion thereof in most cases will cost you an additional $10.00 USD.

Why Would You Need Your Divorce Records
After a divorce many debt collectors will still attempt to place a lean on your assets because of something your ex-spouse has done. In an effort to defend yourself you are going to quickly tell them that you are no longer married to the bum. Then they are going to ask you for proof! This is where most people are lost and normally end up getting their bank accounts drained for something that they had nothing to do with whatsoever.

(Can you tell that I have been through this a time or two?)

If you have your divorce records handy all you have to do is fax it over to the debt collector and problem solved.

As always your comments are always welcomed.
